The Administrative Review Tribunal: what’s been retained from the AAT; what’s new for the ART; and what are the biggest changes for how merits review proceedings are to be conducted.

In this seminar series presented by the Federal Dispute Resolution Section of the Law Council of Australia, practitioners will be provided with a comprehensive analysis of the legislation introducing the new federal merits review tribunal to understand what has been retained from the AAT and what new measures are being brought in with the introduction of the ART. Presenters will also address what, in practical terms, is likely to change for how federal external merits review proceedings are to be conducted.

The Administrative Review Tribunal National Seminar Series will be held in the capital of each Australian State in July 2024. Darwin will be broadcasted live online concurrently with the seminar held in Adelaide.

Peter Woulfe, Chair of the Federal Dispute Resolution Section and Kate Slack, Executive Member of the Federal Dispute Resolution Section, who both have extensive experience appearing in the AAT, will be joined by members of the Tribunal for each seminar in the series. Peter and Kate are both members of the Law Council of Australia’s Federal Administrative Law Reform Working Group who prepared the Law Council’s submission on the Administrative Review Tribunal Bills to Parliament. As a result, they have gained extensive knowledge of Parliament’s proposal for the ART.

The first seminar in the series will be presented in Melbourne on Monday, 1 July 2024 by the Honourable Justice Emilios Kyrou AO, President of the Administrative Appeals Tribunal, Peter and Kate. Please find details of all of the other seminars in the series, here

Each session will comprise of a 1-hour presentation, followed by a 30-minute Q&A segment. By conducting the seminars in this format, it is hoped that practitioners will participate in the Q&A discussion and take up the opportunity to ask questions and seek clarification about how matters will be conducted in the ART.

Light refreshments will also be served before each seminar providing attendees with an opportunity to discuss issues concerning the ART with those also practising in the jurisdiction.
